US Court Orders Freedom of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.

The case originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was detained in immigration detention.

In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court proceedings center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

The judge, who was overseeing his petition to deportation in a federal court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
